The Platform and all services are offered on an "as is" and "as available" basis without warranties of any kind. BR Product Factory LLC disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
BR Product Factory LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses resulting from your use of the Platform.
We may update these Terms from time to time. We will post the revised Terms on this page with an updated effective date. Material changes will be communicated through the Site or by email when reasonably practicable. Your continued use of the Site after the revised Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Site.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles. You and BR Product Factory LLC each agree that any legal action or proceeding arising under or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Douglas County, Colorado, and you consent to the personal jurisdiction and venue of those courts.
Before filing any formal legal action, you agree to first contact us at Communications@brproductfactory.com to attempt to resolve the dispute informally. We will attempt to respond within thirty (30) days. If we cannot resolve the dispute informally, the parties may pursue available legal remedies subject to the Governing Law and Jurisdiction section above. Each party will bear its own costs and attorneys' fees in any such action unless otherwise determined by a court of competent jurisdiction. To the extent permitted by law, you agree that any claim must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
The Site and all content provided by us, including text, graphics, logos, page designs, software, and the OurUSAVoice name and brand, are owned by BR Product Factory LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from any part of the Site.
By submitting content to the Site (including questions, votes, comments, or feedback), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, display, distribute, and aggregate that content for the purpose of operating, improving, and promoting the Site and our services. We may display submitted content in anonymized or aggregated form. You represent that you have the right to grant this license and that your submissions do not violate the rights of any third party.
You agree not to use the Site in any way that violates any applicable law or regulation, infringes on the rights of others, or interferes with the operation of the Site. Prohibited activities include, but are not limited to:
Automated access: Using bots, scrapers, crawlers, or other automated tools to access, collect data from, or submit content to the Site, except for legitimate search engine crawling.
Vote manipulation: Creating multiple accounts, using fake phone numbers, or taking any action intended to artificially influence voting results.
Harassment and abuse: Posting content that is harassing, threatening, defamatory, obscene, hateful, or otherwise objectionable, or directing such content at other users.
Security violations: Probing, scanning, or testing the Site's vulnerabilities; bypassing security features; or attempting to gain unauthorized access to accounts, systems, or data.
Misrepresentation: Impersonating another person, falsely representing your affiliation with any individual or organization, or providing false information when creating an account.
Disruption: Transmitting viruses, worms, or other malicious code; overloading the Site's infrastructure; or interfering with any other user's use of the Site.
We reserve the right to investigate suspected violations, suspend or terminate accounts at our discretion, and report unlawful activity to law enforcement.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving the original intent of the parties as closely as possible.
